COBRA The Consolidated Omnibus Budget Reconciliation Act (COBRA) gives workers and their families who lose their health benefits the right to choose to continue group health benefits. COBRA generally requires that group health plans sponsored by employers with 20 or more employees in the prior year offer employees and their families (Qualified Beneficiaries) continuation coverage in certain instances (Qualifying Events) where coverage under the plan would otherwise end. COBRA requires employers and plans to provide certain notices and outlines how employees and family members may elect continuation coverage. HIPAA The Health Insurance Portability and Accountability Act (HIPAA) protects all "individually identifiable health information" held or transmitted by a covered entity or its business associate. The Privacy Rule established national standards for the protection of Protected Health Information (PHI); the Security Rule established standards for protecting ePHI (Protected Health Information that is held or transferred in electronic form). Under HIPAA, individual and group plans that provide or pay the cost of medical care are “Covered Entities" and must comply with HIPAA Privacy & Security regulations. HI-TECH regulations under the American Recovery and Reinvestment Act (ARRA) require Business Associates to comply directly with Security Rule provisions. HI-TECH also requires Business Associates to develop and enforce related policies, procedures, and documentation standards and sets breach notification obligations for Covered Entities and Business Associates.
